WHAT IS THE “MEANS TEST”?

If you are considering bankruptcy, you must first determine if you are eligible. Congress has passed a law which requires you to fill out an official form called the "means test." You must satisfy this test before you can file for regular bankruptcy. If you "pass" the test then you can file for regular bankruptcy. If you do not pass the test, then you may consider filing for Chapter 13 or what is called a wage earner plan.
